1. Health & Physical Activity Risk Disclaimer

1.1 No Medical Advice

All content, exercise routines, training plans, and advice found on this website or delivered during coaching sessions are designed for educational and informational purposes only. The information provided is not a substitute for professional medical advice, diagnosis, or treatment.

1.2 Medical Clearance

Before participating in any exercise program, personal training sessions, or physical activities detailed on this website, you must consult your GP or a qualified medical professional. This is especially critical if you have a history of high blood pressure, heart disease, chest pain, severe obesity, bone or joint problems, or any other underlying medical condition.

1.3 Assumption of Risk

Physical exercise is inherently strenuous and carries a risk of injury. By engaging with our services, you voluntarily assume all risks associated with physical training. [Insert Business Name] accepts no liability for any injuries, losses, or damages sustained as a result of following the advice on this site or participating in training sessions, except where such liability cannot be excluded by UK law.

2. Multi-Environment Training Clause

Training sessions are delivered across various settings, including client properties, the trainer’s property, and public outdoor spaces. Specific terms apply to each environment:

  • Client Homes: When training takes place at your residence, you are responsible for providing a safe, clean, and completely unobstructed workout space. You must ensure the environment is free from hazards, pets, and children during the session. The trainer reserves the right to cancel a session immediately without a refund if the environment is deemed unsafe.
  • Trainer’s Property: Sessions held at the trainer's property are strictly by appointment. Clients must follow all safety instructions regarding equipment use and property boundaries.
  • Public Spaces: Sessions held in public parks or open spaces around County Durham or anywhere in the UK are subject to weather conditions and local bylaws. The trainer reserves the right to relocate or reschedule an outdoor session at short notice if the weather or ground conditions present a safety hazard (e.g., sheet ice, lightning, or severe flooding).

3. Privacy & Data Protection Notice

Compliant with the UK GDPR and Data Protection Act 2018

3.1 Data We Collect

We collect personal information necessary to deliver safe personal training services. This includes your name, contact details, emergency contact information, and sensitive health data collected via a Physical Activity Readiness Questionnaire (PAR-Q).

3.2 Legal Basis for Processing

We process your contact data to fulfill our personal training contract with you. We process your sensitive health data (PAR-Q) under the legal basis of explicit consent, which is mandatory to ensure your safety during exercise.

3.3 Data Retention

To comply with standard UK fitness industry insurance requirements (e.g., FitPro, CIMSPA guidelines) and to defend potential legal claims, your PAR-Q forms, assessment notes, and training records will be stored securely for a minimum of seven (7) years following your final training session. After this period, your data will be permanently destroyed.

3.4 Your Rights

Under UK GDPR, you have the right to access the personal data we hold about you, request corrections, or object to direct marketing. To exercise these rights, please contact us using the details provided in the Legal Notice above.

4. Booking & Cancellation Terms

4.1 The 24-Hour Rule

We enforce a strict 24-hour cancellation policy. If you need to cancel or reschedule an in-person session, you must give at least 24 hours' notice. Cancellations made with less than 24 hours' notice will be charged at the full session rate.

4.2 Late Arrivals

Sessions will begin and end at the scheduled times. If you are late for a session, the training time will be shortened accordingly, and you will still be charged for the full duration.

5. Payment Terms

5.1 Payment Methods

We accept payments exclusively via Cash or Bank Transfer (BACS).

5.2 Payment Terms

  • Single Sessions: Payment must be made in full via bank transfer at least 24 hours before the scheduled session, or in cash immediately at the start of the session.
  • Block Bookings: All block bookings or monthly packages must be paid in full upfront via bank transfer before the first training session begins.
